SUMMARY

The Ironstone Community Action Group (ICAG) challenged the Minister's approval of a project to extend an open cut coal mine. ICAG was concerned about the impact of the mine on water quality, endangered species, biodiversity and human health in the region. Preston J granted approval for the open cut coal mine, but imposed substantially revised conditions to minimise the impact of coal dust, noise and harm to affected species. The applicant did not raise and the court did not consider mitigation of the climate change impacts.
