SUMMARY

The Court upheld the Council's rejection of an application for subdivision of coastal land into 80 lots in part due to the impact of climate change on coastal land. The applicable Development Plan contained objectives relating to climate change, including the need to make provision for the inland retreat of foreshore, dunes and associated native vegetation. Northcape's appeal to the Supreme Court of South Australia was unsuccessful.
