SUMMARY

This matter concerned an appeal against the decision by the Northern Grampians Shire Council to refuse a development permit for the construction of a new dwelling on a property in the Northern Grampians. The Tribunal upheld the Council's decision. The Tribunal identified adequacy of access as the sole issue upon which the matter was based. In rejected the application, the Tribunal held that the applicants could not guarantee that access to the property could be ensured for emergency and other vehicles, in a safe manner. As such, the permit was denied.
