SUMMARY

Four proceedings were launched in relation to a development permit, and its expiry date. The development consisted of 14 parcels of land, situated within the Wildfire Management Overlay. Various conditions were attached to the permit, including a requirement to set aside land to preserve certain remnant trees. The matter concerned contested interpretations of when particular aspects of planning of the development had to be submitted, to prevent the permit from expiring. Ultimately, the Tribunal found that the permit had expired, and should not be extended.
