(Excerpt from summary of Tribunal’s decision) Two Rocks Investments Pty Ltd, New Orion Investments Pty Ltd and Atlantis @ Two Rocks Pty Ltd sought review by the Tribunal of the decision of the Western Australian Planning Commission not to approve the North Two Rocks Local Structure Plan No. 91, but rather to require the landowners to modify the proposed structure plan in terms of a schedule of 29 modifications and resubmit it, modified in that manner, to the Commission for approval for a period of 10 years. … The dispute relates primarily to the development of the coastal portion of the land. … This case is of significance in relation to coastal foreshore planning in Western Australia in the era of climate change and consequent predicted sea level rise and other coastal processes.
