SUMMARY

Environmental Defender's Office lawyers, acting on behalf of the Nature Conservation of NSW, are challenging the validity of the Border Rivers Water Sharing Plan (WSP). They argue that the NSW Government failed to properly consider future climate change when making the plan. The first interlocutory judgment was handed down in June 2022. Procedure — applicant seeks leave of court to rely on expert evidence concerning climate change related topics in judicial review proceedings challenging making of a water sharing plan for the Border Rivers region. In March 2024, the NSW Nature Conservation council discontinued legal proceedings.
