SUMMARY
The applicant filed two separate actions, but with a degree of overlap with each other, challenging the Chairman of the Environmental Protection Authority's approval of an application by Woodside Energy Ltd for changes to the Pluto Liquefied Natural Gas (LNG) Project proposal pursuant to s 45C(1) of the Environment Protection Act 1986 (WA). In the first (CIV 2247 of 2020), the applicant argued that the changes might have a significant detrimental effect on the environment, additional to the original proposal, from increased greenhouse gas emissions. In the second action (CIV 2246 of 2020), the applicant argued that the respondent’s exercise of discretion under s 45C was beyond power.
