SUMMARY
The case concerned proposals for broiler farms (a broiler is a barnyard fowl raised for meat). An objector argued that the proposed broiler farms would contribute to the discharge of greenhouse gases and adverse effects on the environment. The Tribunal acknowledged that “Climate change, its effects and policy requirements, are not limited to this area or Victoria. They are national and global questions. They call for national and global responses and policies. They cannot be effectively dealt with on a case by case ad hoc basis, or by refusing individual planning permit applications for broiler farms or other relevant uses and developments.” The Tribunal, however, was charged with making decisions on planning permit applications on their planning merits. In this case, this did not extend to refusing otherwise acceptable broiler farm proposals on the basis argued for by the objector.
