SUMMARY

Contact Energy Limited was granted resource consents by the Auckland Regional Council to construct and operate a 400MW gas fired combined cycle power station in South Auckland. The Environmental Defence Society sought the imposition of a condition on the air discharge consent requiring Contact to offset all the CO2 emissions by planting trees to act as carbon sinks. 

This case was immediately followed by a case that raised similar questions - Environmental Defence Society Incorporated v Taranaki Regional Council A184/2002 [2002] NZEnvC 441.
