SUMMARY

The case concerned resource consents sought by Contact Energy Limited to allow it to dam, divert, take, use and discharge water so as to generate electricity from the Clutha River in the Otago region. The Otago Regional Council appointed independent commissioners to consider the consents. They granted, on conditions, resource consents relating to Lake Hawea, the Clyde Dam and Lake Dunstan, and Lake Roxburgh. The Court confirmed all the water permits sought ought to be granted, subject to different conditions. Some of the issues raised related to flood risk due to climate change.
