Fonterra, a significant manufacturer and marketer of dairy products, sought use and discharge consents to enable it to build a duel fuel energy centre capable of burning either gas or coal to power its factory. The Court found that the proposal met the purpose of sustainable management as defined in s 5 of the Resource Management Act 1991.
