[1] This appeal seeks the cancellation of a series of resource consents for improvement works and maintenance to the Lindsay Creek and water of the Leith.

[9] Consents sought by the Otago Regional Council are for a flood control scheme for the Leith between the botanic gardens in Dunedin to just below the Forth Street Bridge and for the Lindsay Creek which flows through North East Valley from Potters Road Bridge to its confluence with the Leith at the southern boundary of the botanic gardens.
