SUMMARY

Greenpeace and other NGOs sought declarations that websites and other related material were not election advertisements. The Electoral Commission had advised Greenpeace and the NGOs that they were election advertisements and subject to regulation, particularly expenditure restrictions, registration and other associated obligations. The Court held that the material was not election advertisements.
