SUMMARY

(Excerpt from judgment)

[1] These are humanitarian appeals by the appellants, who are citizens of Tuvalu, against their liability for deportation which arose when they became unlawfully in New Zealand.

[2] The appellants are a married couple. The wife is aged 22 years and the husband is aged 23 years.

[3] The primary issue on appeal is whether the appellants’ desire to stay in New Zealand and their concerns about their likely living conditions in Tuvalu give rise to exceptional humanitarian circumstances.
