SUMMARY

In August 2021, New Brighton applied for an order striking out the statement of claim. The judge declined to rule on this application, pending the determination of the substantive judicial review application. Bathurst Resources sought to establish a new coal mine in Southland. The Royal Forest & Bird Protection Society of New Zealand Incorporated sought judicial review of the Southland District Council's decision to enter into an access agreement for coal exploration and to authorise officers to negotiate an access arrangement for land for mining purposes. The application for review was dismissed.
