Bushfire Survivors for Climate Action launched judicial review proceedings challenging the Independent Planning Commission's approval for an extension of Whitehaven Coal's Narrabri Underground mine. The judicial review application was heard from 15 February to 17 February 2023. On 5 July 2023, the Court dismissed the proceedings. Duggan J found that the decision to grant development consent for an extension to the Narrabri Underground Mine Extension was not legally unreasonable.
