SUMMARY

The Appellants lodged an appeal against certain decisions of the Waikato District Council on the Proposed Waikato District Plan (at [1]). The Appellants sought leave to amend their notice of appeal that the Council opposed on the basis that much of the relief sought was out of scope (at [12]). Some of the appeal points in the Appellants’ amended notice of appeal related to climate change — see, eg, at [34], [63], [83] and [89]–[91]. The Tribunal held that such appeal points were out of scope (see at [91]).
